The general terms and conditions that apply between you and Eychgras UG when you buy from us or use eychgras.de.
1. Scope of these terms
These general terms and conditions (the "Terms") govern your use of eychgras.de (the "Site") and every purchase you make from the Eychgras shop. They apply between you (the "Customer") and Eychgras UG (haftungsbeschränkt), Kreuzbergstraße 71, 10965 Berlin, Germany, registered with Amtsgericht Charlottenburg under HRB 267,441 B ("we", "us", "Eychgras").
Terms other than these — including any general terms of yours — apply only if we have agreed to them in writing.
2. Offer, order, and conclusion of contract
Product listings on the Site are an invitation to treat, not a binding offer. When you place an order by clicking "Complete order", you make a binding offer to purchase the items in your cart at the prices shown. We accept your offer by sending you an order confirmation by email; the contract is concluded when that email is dispatched.
If we cannot fulfil an order — for example, because an item is no longer available — we will notify you within three business days and refund any payment already taken. No contract comes into being in that case.
You may place orders in English or German. The order text is stored by us but is not accessible to you after purchase; we can send you a copy on request.
3. Prices, VAT, and payment
All prices are shown in Euro (€) and include German value-added tax (Umsatzsteuer, currently 19%) where applicable. Shipping is charged separately and shown at checkout; see the shipping page for the current rates.
We accept the following payment methods, processed by Stripe Payments Europe, Ltd.:
- Debit and credit cards (Visa, Mastercard, American Express);
- SEPA direct debit (for EU billing addresses);
- Apple Pay and Google Pay;
- Klarna "Pay in 30 days" (subject to Klarna's own approval; DE/AT/NL only);
- PayPal.
Payment is due at the time the order is placed. Ownership of the goods passes to you upon full payment (§ 449 BGB — retention of title).
4. Delivery
We ship from Berlin, Germany, via DHL Paket. Lead times shown on the shop and product pages are typical; they are estimates, not guarantees. Shipping details, rates, and delivery regions are on the shipping page.
If a delivery is delayed by more than 30 days beyond the estimate given at checkout, you may set us a reasonable additional period and — if that period passes without delivery — cancel the contract and receive a full refund.
5. Right of withdrawal (consumers in the EU)
If you are a consumer resident in the European Union, you have a statutory right to withdraw from this contract within 14 days without giving any reason.
5.1 Withdrawal period
The withdrawal period is 14 days from the day on which you (or a third party other than the carrier and indicated by you) took physical possession of the goods; for an order of several goods delivered separately, from the day the last of them was taken into possession.
5.2 How to exercise it
To exercise the right of withdrawal, inform us — Eychgras UG, Kreuzbergstraße 71, 10965 Berlin, [email protected] — by a clear statement (for example, a letter sent by post or an email). You may use the model withdrawal form below, but that is not required.

5.3 Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of supplementary costs arising from your choice of a delivery type other than our least expensive standard delivery), without undue delay and at the latest 14 days after we receive your withdrawal. We will make the reimbursement using the same means of payment as you used for the initial transaction unless expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earliest.
You shall send back the goods or hand them over to us without undue delay and in any event no later than 14 days from the day on which you communicate your withdrawal. The deadline is met if you send back the goods before the 14-day period has expired. You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics, and functioning of the goods.
6. Warranty
Statutory warranty rights apply. For consumers, the warranty period is two years from delivery (§ 438(1) no. 3 BGB). If a defect appears within the first year, it is presumed to have existed at the time of delivery unless there is a serious reason to believe otherwise (§ 477 BGB, as amended). We inspect returns fairly. For genuine defects we replace, repair, or refund at our option, at no cost to you.
7. Liability
We are liable without limitation for damage arising from injury to life, body, or health caused by us, our legal representatives, or our vicarious agents, as well as for damage covered by the German Product Liability Act (Produkthaftungsgesetz).
For other damage, we are liable without limitation only in cases of intent or gross negligence by us, our legal representatives, or vicarious agents. For simple negligence we are liable only for breach of a material contractual obligation ("Kardinalpflicht"); in that case liability is limited to the foreseeable damage typical for a contract of this kind.
Any further liability is excluded.
8. Online dispute resolution
The European Commission provides a platform for online dispute resolution (ODR) at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute-resolution proceedings before a consumer arbitration body.
9. Applicable law and jurisdiction
These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer resident in another EU member state, the mandatory consumer-protection provisions of your country of residence continue to apply.
For merchants ("Kaufleute") within the meaning of the German Commercial Code, legal entities under public law, or special funds under public law, the place of jurisdiction is Berlin.
10. Severability
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions is not affected. The invalid provision shall be replaced by the applicable statutory provision.
